1. Acceptance of Terms
(a) Every vehicle assessment is strictly a visual, non-mechanical overview. Newcastle Auto Inspections assumes no liability for latent or hidden defects that could not be detected during a standard visual examination. The scope of this check encompasses the vehicle’s exterior panels, interior cabin, engine bay, wheels and tyres, braking components, undercarriage, and a brief local road test where feasible. This service explicitly excludes any items listed under our standard Excluded Items Policy available at www.newcastleautoinspections.com.au/terms, and our technicians will not remove any parts or components during the process. While we employ industry-accepted assessment methods, you acknowledge that these techniques may not uncover every underlying mechanical fault. This report must be evaluated in combination with the specific age and overall wear of the vehicle, and road testing is strictly capped at local area speed limits.
2. Description of Service
(b) The provided evaluation report reflects the vehicle’s condition exclusively at the exact time of issuance. Because condition can change rapidly, the buyer retains ultimate responsibility for conducting a personal visual check at the time of final sale. This document does not constitute, and cannot be substituted for, an official roadworthy certificate. Please note that Newcastle Auto Inspections does not cross-reference manufacturer recall databases; it remains your responsibility to verify if the vehicle is subject to active factory recalls.
3. Limitations of Inspection
(c) Newcastle Auto Inspections operates solely as an independent inspector. We are not a party to, nor responsible for, the financial terms or outcomes of any vehicle transaction, nor will we act as an arbitrator in any dispute between buyers and sellers.
4. Payments and Cancellations
(d) Compliant with all relevant legal regulations, Newcastle Auto Inspections makes no explicit guarantees, warranties, or representations regarding the accuracy, completeness, or absolute reliability of the data within this report, nor its suitability for your specific purchasing decisions. To the maximum extent permitted by applicable law, our maximum financial liability for any claims relating to this service is strictly capped at the greater of: (A) $1,000; or (B) five times the fee paid by you for this inspection.
5. Liability
(e) Save for liabilities that cannot be legally waived, Newcastle Auto Inspections will not be held liable for any damages or claims arising from your reliance on or use of this report, whether pursued under contract law, torts (including negligence), indemnity claims, statutory breaches, or strict liability. (f) Under no circumstances shall Newcastle Auto Inspections be liable for any indirect or consequential damages. This includes, but is not limited to, loss of vehicle use, lost business profits, missed revenue, data loss, delayed transactions, financing fees, or increased operational expenses. (g) By accessing and utilizing this inspection report, you agree to be bound by the full Newcastle Auto Inspections Terms of Service available at www.newcastleautoinspections.com.au.
